Lasting Powers of Attorney

We do not like to consider the possibility of being incapable of managing our affairs; still less actually making plans for such an eventuality. Yet putting a Lasting Power of Attorney (LPA) in place before an emergency arises will save heartache, money, and assure peace of mind for all. It is important that a Lasting Power of Attorney specific to your needs be arranged, again with an eye on long term care.

A Lasting Power of Attorney will enable a relative or close friend to act on your behalf in the event that you lose the ability to manage your own financial affairs, whether through mental or extreme physical disability. This can range from writing cheques to selling properties. You can have more than one Attorney, either acting together or independently. A Lasting Power of Attorney should not be confused with a Power of Attorney, which will cease at the onset of mental disability. But remember, a Lasting Power of Attorney must be in place before the onset of mental disability to be effective and as well as a witness, you will require a Certificate Provider to certify that you are of sound mind and fully understand the implications of the LPA when you sign it.  Further, an LPA cannot be used until it has been registered by the Office of the Public Guardian.

There are two types of Lasting Powers of Attorney: an LPA Property & Financial Affairs is in relation to your financial affairs, so your attorneys will be able to act for you in relation to making and receiving payments, buying and selling property and investments, etc.; a Health & Welfare LPA gives your attorneys authority to make decisions on your behalf if you can no longer make these yourself on subjects such as which nursing home you should live in, the level of care you are to receive, which social or cultural activities you should partake in, consenting to any medical treatment, etc.. If you wish, you can also grant your attorneys power to make decisions regarding life-sustaining treatment.

You can choose to have one or both types of LPA.
